Terms of Service

These terms cover your use of The Pet Care Card. Please read the parts about your information, subscriptions, and the AI photo features carefully.

1. About these terms

These Terms of Service ("Terms") are an agreement between you and The Perception Collective Pty Ltd ("we", "us", "our") for your use of The Pet Care Card app and website. By using The Pet Care Card, you agree to these Terms.

2. What The Pet Care Card is, and is not

The Pet Care Card is a tool that lets you record and organise your pet's care information, and create fun images of your pet. It is not veterinary advice, diagnosis or treatment, and it is not a monitoring or emergency service. Always rely on a qualified veterinarian for your pet's health, and contact a vet or emergency animal service in an emergency.

3. Your information is your responsibility

You are responsible for the accuracy of the information you enter, and for how you share anything you export, such as a PDF care sheet. Share exports only with people you trust. Your pet records are stored on your device; we recommend you keep your own backup using the in-app export, as we cannot recover records that are lost.

4. Your account

You may sign in with Google to create an account that holds your plan and credit balance. You are responsible for keeping access to your account secure. See our Privacy Policy for what we collect.

5. Free trial, subscriptions and purchases

• Free trial. New users get a free trial that includes a set number of AI image credits, with no card required to start. After the trial, a paid plan is required to keep using the app.
• Plans. We offer monthly and annual auto-renewing subscriptions, a one-off "Lifetime" purchase, and one-time top-up credit packs. Current prices are shown in the app and at the point of purchase.
• Auto-renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends. You can manage or cancel a subscription in your App Store or Google Play account settings, or, for web purchases, through the billing portal in the app.
• Payment. Payment is charged to your Apple ID or Google account for in-app purchases, or to your nominated payment method through our payment provider (Stripe) for web purchases, at confirmation of purchase.
• Credits. AI features consume credits. Subscriptions include a credit allowance each period; top-up packs do not expire. Credits have no cash value, are not refundable except as required by law, and are not transferable.
• GST. App store prices are shown inclusive of GST. Web prices are shown plus GST.

6. AI photo features and intellectual property

• You may only upload photos you have the right to use. Do not upload photos of other people without their consent, or any content you do not have the rights to.
• The AI scenes are generated by a third-party AI model. Results are produced automatically, may be imperfect or unexpected, and are intended for your personal, non-commercial enjoyment.
• You must not use the AI features to create content that infringes anyone's copyright, trademark or likeness (for example branded characters, logos, or real people), or that is unlawful, deceptive or harmful. We rely in part on the AI provider's safety filters, which are not perfect, and you remain responsible for how you use any output.
• As between you and us, you keep ownership of the photos you provide, and we do not claim ownership of them. Generated images are provided to you for your personal use. We make no warranty that a generated image is free of third-party rights.

7. Acceptable use

You agree to use The Pet Care Card only for lawful purposes, and not to misuse it, interfere with its operation, or attempt to bypass its billing, credit or usage limits.

8. Our intellectual property

The Pet Care Card, including its name, design and software, is owned by us. These Terms do not give you any rights in it beyond using the app as intended.

9. Availability

Your pet records work on your device, but your account, the AI features and billing rely on our servers and third-party providers. We aim to keep the service available and working, but, as with any online service, we cannot guarantee it is always available or completely error-free.

10. Australian Consumer Law and our liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

Subject to those rights, and to the maximum extent the law allows:

• The Pet Care Card is provided "as is".
• We are not liable for any indirect or consequential loss, or for any loss of, or inability to access, your on-device information.
• Where we are entitled to limit our liability, our total liability to you for any claim is limited, at our option, to resupplying the relevant service or refunding the amount you paid for it.

11. Changes to these terms

We may update these Terms from time to time. The current version will always be on this page, with the date shown above. Continuing to use The Pet Care Card means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
